New Delhi.
India’s home ministry denied on Thursday that it had called for a new ban on
gay sex and distanced itself from remarks about homosexuality made in the
Supreme Court by a top government lawyer.
Additional
solicitor general P.P. Malhotra, who said he was representing the home
ministry, asked the court on Thursday to reverse a landmark decision in 2009
that decriminalized gay sex.
Gay sex “is
highly immoral and against the social order,” Malhotra told the court, adding
that “homosexuality is against nature and spreads HIV.”
In a
statement seeking to clarify the government’s position, the home ministry said
it “has not taken any position on homosexuality” and the cabinet had decided
not to appeal the ruling decriminalizing gay sex.
A
spokeswoman for the home ministry, Ira Joshi, told AFP that there appeared to
have been some “miscommunication.”
The Supreme
Court is hearing more than a dozen petitions filed to overturn a 2009 ruling by
the Delhi High Court that decriminalized gay sex between consenting adults for
the first time.
A
colonial-era ban was judged to be unconstitutional in a decision hailed by gay
activists as a victory in their fight for equal rights and opportunities in the
world’s biggest democracy.
